Article 16

According to the provisions of the Indian Constitution, right to equality has been given from Article 14 to Article 18. In which the Indian Constitution provides equality of opportunity in matters of public employment under Article 16. Equal opportunity under Article 16 reflects a wide coverage, showing no universal agreement on its precise meaning. The provision of this article of the Constitution of India exhibits a broad meaning. Under this, every citizen of India gets equality of opportunity in the field of public employment.

On the basis of equality in matters of equal opportunity for citizens as per the Constitution of India.

1. Equality of public employment opportunity to obtain a job.

2. Public employment equality of opportunity for the process of assessing performance at work.

3. Equality of public employment opportunity for career advancement and enhanced training.

4. Equality of public employment opportunity to enhance the working environment.

5. Equality of public employment opportunity for growth in relationship dynamics at work.

Article 16 (1) - Under this provision of the Constitution of India there shall be equality of opportunity for all citizens in matters relating to employment or appointment to any office under the State.

Article 16(2) - The provisions of this Article of the Constitution of India shall not make any citizen ineligible for any employment or office on grounds only of race, religion, sex, place of birth, descent, residence or any of them can be done. Nor can they be discriminated against for equality of opportunity.

Article 16(3) - Constitution of India Nothing in this article shall prevent Parliament from making such law. Nothing shall prevent any State from making any law with respect to the employment or appointment of any class or classes to any office under any local or other authority within the Union or any State within the Union. Residence within that State or Union Territory shall be required prior to such employment or appointment.

Article 16 (4 ) - Nothing in this article of the Constitution of India shall prevent the State from making any provision for the reservation of appointment or post in favour of any backward class of citizen. which in the interest of the State does not adequately represent such class in the service under the State.

Article 16 (5 ) - Nothing in this article of the Constitution of India shall affect the operation of any law. that the holder of any office in relation to the affairs of any religious or communal institution or any member of its governing body shall be a person professing a particular religion or belonging to a particular sect.

Article 16(6) - Reservation up to 10% of appointments or posts may be made by the State for any economically disadvantaged groups of citizens under the Constitution of India. This additional reservation of up to 10% will be done in addition to the existing one. Any Economically Disadvantaged Group as notified by the Central and State Governments from time to time, on the basis of family income and other economic disadvantage indicators of the citizens.
