The forty second amendment act, officially known as The Constitution 42 amendment Act 1976, was enacted during the Emergency period 1975 -1977 by the Indian prime minister in india by Indira Gandhi.

Most provisions of the 42 amendment came into enforce on January 1977. others provisions were enforced from February 1977 and Section 27 enforce on April 1977. The forty second amendment is regarded as the most controversial constitutional amendment in history of Indian constitution.
